New Home Warranties
In New South Wales (NSW), the standard building warranty for new homes is covered under the Home Building Act 1989. There are two main types of warranties:
Statutory Warranties: These warranties are implied by law and cover:
- Structural Defects: A 6-year warranty for defects related to the structure of the home, such as foundations, walls, and roofs.
- Non-Structural Defects: A 2-year warranty for defects that are not structural, such as issues with painting, tiling, or fixtures.
Home Building Compensation Fund (HBCF): Builders are required to take out HBCF insurance for projects over $20,000. This provides protection to homeowners in case the builder cannot complete the work due to insolvency, death, disappearance, or license suspension. The insurance typically covers claims for up to 6 years for structural defects and 2 years for non-structural defects.
These warranties ensure that builders are responsible for any defects that arise within the warranty period, protecting homeowners from faulty workmanship or materials.
